In an important ruling, the Delhi High Court on Wednesday dismissed a Public Interest Litigation (PIL) about the 'acute shortage' of domestic LPG cylinders, attributing the issue to the ongoing conflict in West Asia. The bench, led by Chief Justice D K Upadhyaya and Justice Tejas Karia, underscored that the matter falls within the domain of the government's responsibilities.
Citing existing orders under the Essential Commodities Act, the court expressed its willingness to refrain from issuing directions perceived as futile, given that the government has already taken steps to address LPG supply shortages. The bench emphasized that such economic matters require careful consideration by the executive, rather than judicial interference.
The court noted that the petitioner failed to provide substantial information regarding LPG exports and criticized the oversimplification of India's diverse energy needs. The bench concluded by closing the petition but allowed the petitioner to seek remedy from appropriate authorities, reinforcing the executive's role in managing such complex policy issues.
