In a significant ruling, the Delhi High Court has granted bail to two individuals accused under the Unlawful Activities Prevention Act (UAPA), citing prolonged incarceration without trial as a major concern. The bench, comprising Justices Navin Chawla and Ravinder Dudeja, emphasized the importance of protecting individual rights under Article 21 of the Constitution.
The court noted the presence of anti-national material on the accused's digital devices but highlighted the absence of direct criminal activity or violent engagement. Stating that health issues and the non-violent nature of the alleged crimes warranted conditional release, the court held that justice would not be served by further detention.
Bail conditions include surrendering passports and refraining from joining problematic social media groups. By distinguishing between ideological affinity and active terrorism participation, the court emphasized the need for balancing national security interests with individual justice, especially when health and prolonged detention weigh heavily.
