The Motor Accident Claims Tribunal (MACT) in India has awarded over Rs 6.41 crore as compensation following the death of Italian engineer Cristina Severi and the injury of her sister Maria Claudia in a 2008 road accident in Rajasthan.
The tribunal ruled that the incident was a result of composite negligence between the drivers of a tourist car and a truck involved in the collision. Despite insurers' attempts to deny liability on technical grounds, the court dismissed these defenses due to lack of evidence.
Significant compensation was granted based on loss of dependency, medical costs, and future income loss, with the funds directed to accounts in Italy to prevent hardship for the claimants.
