Supreme Court Empowers Amputees with Landmark Verdict on Compensation

In a landmark ruling, the Supreme Court has affirmed the right of motor accident victims to receive high-quality prosthetic limbs, recognizing them as essential for restoring life quality and self-belief. The decision emphasized that such devices are crucial to bridging the gap caused by disability.

The bench, led by Justices J B Pardiwala and K V Viswanathan, underscored that prosthetic limbs are not simply medical aids but vital components of an amputee's identity and independence. This ruling emerged from a case involving Prahlad Sahai, a driver who lost his leg in a collision with a Haryana Roadways bus.

Rejecting substandard government compensation rates, the court awarded Sahai nearly Rs 50 lakh in total, including funds for limb replacement and maintenance. The verdict reinforces victims' rights to obtain personalized care from private providers, setting a new precedent in compensation for lost future income and mobility.
