Court Upholds Acquittal in Marital Cruelty and Rape Case

A sessions court has upheld the acquittal of a man accused in a domestic cruelty and marital rape case, following a magisterial court's decision. The judge ruled the allegations as vague and general, particularly pointing out the complainant's contradictory statements in another related case.

Presiding over the criminal revision petition was Additional Sessions Judge Purshotam Pathak. The accused faced charges under sections 377, 498A, and 406 of the IPC. However, the court found no grounds for these charges, agreeing with a 2024 judgment that such offenses cannot arise from marital relationships.

The judge highlighted inconsistencies in the complainant's allegations of forcible unnatural intercourse. Furthermore, the court dismissed charges of cruelty and breach of trust, citing a lack of specific evidence and noting the vague and mechanical nature of accusations against the family members.
