Seeking Justice: Policy Gaps in Road Accident Compensation

The Delhi Motor Accident Claim Tribunal is calling for the Centre's aid to resolve a compensation case where the victim was excluded from government schemes. Presiding Officer Abhilash Malhotra analyzed the petition from the wife of a cyclist killed in a 2024 Delhi road accident.

The tribunal found that both the victim's family and the driver’s legal heirs were trapped in a legal bind, with the driver's impoverished parents unable to inherit any estate. Marking a policy void, the tribunal insisted that the victim's family shouldn't face negligence.

To address the unique circumstances, the tribunal urged the Ministry of Road Transport and Highways to help identify any possible policies that could offer support. A representative's attendance was requested for the hearing on February 27 to advise on potential government compensation for the family.
