In a significant ruling, the Allahabad High Court has prioritized the welfare of a child in a custody battle, awarding custody to the mother. The court noted the father's chronic alcoholism and financial dependency, deciding these factors rendered him unfit for custody.
Justice Sandeep Jain emphasized that the child's welfare must supersede parental legal rights. The court determined the boy's best interests would be served by continuing his education at Bishop Cotton School in Shimla, under his mother's care.
The court also ordered monthly visitation rights for both parents at the school, ensuring a stable and supportive environment for the child amidst parental discord.
