In a landmark decision, the Supreme Court has nullified a Delhi High Court order concerning the eviction of residential premises in Sujan Singh Park, Delhi. The ruling reiterates the legal dominance of the Government Grants Act of 1895 over the Delhi Rent Control Act of 1958 for properties occupied under government grants.
The verdict issued by Justices Sanjay Karol and Prashant Kumar Mishra highlights that the terms of a 1945 government grant regulate the premises, not the DRC Act. Consequently, eviction proceedings based on the latter are deemed invalid, as the central government's occupancy does not fall within a typical landlord-tenant relationship category.
The case dates back to a 1945 lease deed involving the government and Sir Sobha Singh and Sons Pvt Ltd. The Supreme Court asserts that arrangements under the grant agreement, including occupancy by government officials, are immune to DRC provisions, resolving a long-standing legal challenge.
