The Transgender Persons (Protection of Rights) Amendment Bill, 2026, which recently received President Draupadi Murmu's assent, has ignited significant controversy. The legislation, which introduces graded punishment for causing harm to transgender persons, has faced strong criticism for its exclusionary approach towards gays and lesbians.
Critics argue that the bill restricts self-determination of identity by establishing an authority to determine transgender status. Opposition MPs have condemned the legislation for not encompassing different sexual orientations, insisting that it undermines the rights of individuals with diverse identities.
Despite the government's stated objective to protect transgender individuals, the opposition is urging a reassessment, recommending that the bill be forwarded to a standing committee for further consultation. The bill seeks to offer a specific definition of 'transgender' and excludes categories beyond traditional transgender definitions.
