The Allahabad High Court has reaffirmed the rights of transgender individuals by ruling that a certificate issued by a district magistrate under the Transgender Persons (Protection of Rights) Act, 2019 serves as conclusive proof of gender identity for passport issuance.
In a significant ruling, Justices Atul Sreedharan and Siddharth Nandan stated that passport authorities could not mandate an additional medical examination or require changes to the birth certificate to alter a gender designation in a passport. The decision came in response to a petition brought by Khush R Goel, who challenged a directive for a new medical evaluation after undertaking gender reassignment and securing official recognition of his gender identity.
The court emphasized that the 2019 legislation was introduced to combat social ostracization of transgender individuals by ensuring their dignity and equal rights. Its ruling nullifies the previous requirement for further medical checks, marking a step forward in protecting the rights and recognition of transgender persons in society.
