Justice Alok Mehra, sitting in a single bench, affirmed the Nainital District Court's award of Rs 53,93,600 to the kin of the accident victim, deeming it both fair and justified. The decision underscores the court's commitment to ensuring adequate financial recompense as envisioned by welfare laws.
The insurance company's appeal challenged a Motor Accident Claims Tribunal order that mandated payment with an annual interest, arguing the sum was disproportionate. However, the court asserted that the Motor Vehicles Act prioritizes prompt and adequate compensation, highlighting the courts' obligation to adopt a liberal approach in such cases.
