The plea, presented before justices Vikram Nath and Sandeep Mehta, was initially scheduled for consideration on October 28 following a notice issued by the court on October 7. However, the case was not listed for that date, prompting its rescheduling for November 25.

According to the application filed through advocate Lzafeer Ahmad, the video implies that if the BJP loses power in Assam, Muslims will take over significant areas such as tea estates and Guwahati airport. The plea argues that as a secular state, Assam's government must uphold constitutional values and urges the removal of the video to prevent communal disharmony.
