Trinamool Congress leader Derek O'Brien has strongly criticized recent bills that sanction the removal of the prime minister, chief ministers, and ministers detained for 30 days, highlighting the risk of turning arrests into political weapons.
O'Brien, in a blog post, underscored that these bills could undermine democracy by nullifying the presumption of innocence and destabilizing governance. He warned that the bills could lead to governance halts by overriding electoral mandates without judicial convictions.
Citing India's high percentage of undertrial prisoners, O'Brien emphasized that the legislation equates detention with guilt and limits judicial processes. He highlighted concerns regarding potential misuse, as the bills shift accountability from conviction to custody, threatening democratic principles.
