The Delhi High Court has put an end to a 17-year-old case, dismissing an attempted murder charge against academician Madhu Kishwar. The court highlighted the malicious motivations behind the FIR, framing it as a retaliatory measure against Kishwar.
The court criticized the misuse of legal machinery, asserting that lodging a complaint merely because it outlines a cognisable offense undermines judicial process integrity. Justice Amit Mahajan noted that the allegations against Kishwar were reactionary, pinpointing a prior altercation where unlawful assembly and injury were involved.
The charges dated back to a December 2007 dispute concerning shop allotment in the Kotla Mubarakpur area, where Kishwar was accused of violence during a confrontation. However, the high court recognized the manipulative nature of the complaint, upholding previous rulings in Kishwar's favor.
