Delhi High Court Upholds Police Search Validity Without Videography
The Delhi High Court ruled that the absence of videography or photography does not invalidate police searches in narcotic cases. Justice Ravinder Dudeja stated that while technology enhances investigations, lack of video proof doesn't negate police testimony. The Delhi High Court has emphasized the validity of police search operations even when conducted without videography or photography in narcotic cases. Justice Ravinder Dudeja stated that though modern technology can enhance transparency and efficacy, police accounts should not be dismissed solely due to lack of video evidence.
This ruling emerged as the court denied bail to two foreign nationals, Stanley Chimeizi Alasonye and Henry Okolie, involved in a narcotics case from 2021. They were apprehended with a substantial quantity of heroin, along with chemical powders allegedly used for drug manufacturing found in their accommodation.
Justice Dudeja dismissed their bail applications, noting absence of independent recovery witnesses cannot solely justify granting bail. The court also highlighted concerns regarding the accused being flight risks, lacking permanent addresses in India.
