The Lucknow Bench of the Allahabad High Court, on Saturday, paused a previous directive to file a First Information Report (FIR) against Congress leader Rahul Gandhi, following allegations that he holds British citizenship. The court emphasized the necessity for Gandhi to present his defense before reaching a conclusive verdict.
This temporary stay prevents the registration of an FIR, ensuring the judicial review process remains intact. The spotlight shines on a petition originating from BJP member Vignesh Shishir, who resorted to the high court after an MP-MLA court in Lucknow dismissed the plea in January 2026, contending Gandhi's alleged breach of Indian citizenship law by possessing British nationality.
The petition further alleged violations under multiple legal provisions such as the Bharatiya Nagarik Suraksha Sanhita, Foreigners Act, and the Passport Act. Shishir accused Gandhi of sharing sensitive information with foreign entities and acquiring a fraudulent passport, which he deems a serious constitutional infringement.
