Kash Patel, the FBI Director, has initiated a defamation lawsuit against The Atlantic and its journalist Sarah Fitzpatrick. The lawsuit follows an article that accused Patel of having a drinking problem, potentially putting national security at risk. The article was initially titled “Kash Patel's Erratic Behavior Could Cost Him His Job” and then re-titled online as “The FBI Director Is MIA.”

The lawsuit, filed in U.S. District Court for the District of Columbia, seeks $250 million in damages. It argues that The Atlantic ignored Patel's denials about the allegations and acted with actual malice, a legal standard requiring knowledge of falsehoods or reckless disregard for the truth. Despite denials from the FBI and Patel beforehand, the publication went ahead with its story.

The case raises questions about media practices and public figures' rights, especially those linked to former President Trump, as Patel’s attorney Jesse Binnall is known for his legal representation of prominent Republicans. Binnall has indicated confidence in proving the allegations in The Atlantic’s story are defamatory and harmful to Patel’s reputation.
