EU Court Champions Gender Identity Rights

The European Union's highest court has declared that national laws blocking changes to gender information violate EU law. This landmark decision points to the challenges faced when an individual's lived gender identity differs from official documents.

The case involved a Bulgarian citizen, identified male at birth, who has begun transitioning and identifies as female. After relocating to Italy, she requested changes to her legal gender, name, and ID number. Bulgarian courts denied her request, enforcing rules that define sex strictly biologically.

The European Court of Justice emphasized that discrepancies in gender identity and identification documents can lead to issues during routine checks and travel, thereby obstructing the right to free movement within the EU.
